The Wetland Mitigation Banking Program supports the establishment and development of agricultural wetland mitigation banks to make credits available to producers. These credits help producers meet their wetland conservation compliance responsibilities to maintain eligibility for many USDA programs administered by the FSA and NRCS, and maintain eligibility for the Federal crop insurance premium subsidy administered by the USDA Risk Management Agency.

What Is This Program?

NRCS will seek applications to establish wetland mitigation banks for agriculture producers. The intent of the program is for qualified third-party wetland bankers to operate and manage all aspects of a wetland mitigation bank, with oversight by NRCS. Specific funding uses and restrictions will be identified in an agreement between NRCS and those selected to receive the funding.

The Wetland Mitigation Banking Program provides a mechanism for agricultural producers to compensate for unavoidable wetland impacts to maintain eligibility for USDA programs, often through the purchase of wetland mitigation credits. It also supports the restoration, creation, or enhancement of wetlands through specific projects. Participants can also access free technical assistance and potentially cost-share assistance through associated NRCS conservation programs (AMA, EQIP, CSP, RCPP) if they meet compliance requirements.

Who Is Eligible?

Industries: agriculture, forestry

Region: all US states and territories (state-specific ranking dates apply)

Other Criteria: agricultural producers, ranchers, or landowners, non-industrial forest managers, seeking to compensate for unavoidable impacts to wetlands, seeking benefits through most USDA programs, must meet conservation compliance (Swampbuster provisions), establish a farm tract number with USDAโ€™s Farm Service Agency, certify compliance with adjusted gross income limitation (AGI) provisions, certify compliance with highly erodible land and wetland conservation requirements, have control of the property (deed or lease agreement)
