Section 40904(b) of the Bipartisan Infrastructure Law, also known as the Infrastructure Investment and Jobs Act, authorized the Secretary of the Interior to fund the rehabilitation, reconstruction, or replacement of a dam in which construction began on or after January 1, 1905, developed pursuant to the Carey Act (43 U.S.C. 641). What Is This Program?

The Carey Act Dam funding is set aside for reconstruction of a dam developed under the authority of the Cary Act after 1905. The Governor of the state in which the dam is located must request the funding and determine that the dam meets the applicable criteria described in the law.
